Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Hemp Temps website (hemptemps.com), mobile application, and staffing services provided by Hemp Temps LLC ("Hemp Temps," "we," "our," or "us"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Services

Hemp Temps is a cannabis workforce staffing agency that connects licensed cannabis businesses ("Client Companies") with pre-screened workers ("Workers") for temporary, temp-to-perm, and direct hire placements. Hemp Temps acts as the employer of record for Workers placed on a temporary basis.

Our services are available only in U.S. states where cannabis is legally licensed and where Hemp Temps is approved to operate. A current list of approved states is available at hemptemps.com/approved-states.

2. Eligibility

To use our services, you must:

  • Be at least 21 years of age
  • Be legally authorized to work in the United States (for Workers)
  • Hold a valid cannabis business license or operate within a licensed cannabis facility (for Client Companies)
  • Comply with all applicable state and local cannabis regulations

3. Client Company Obligations

Client Companies using Hemp Temps staffing services agree to:

  • Maintain a valid, active cannabis business license throughout the engagement
  • Provide a safe and lawful working environment compliant with applicable OSHA, state labor, and cannabis industry regulations
  • Not discriminate in the use of Hemp Temps services on the basis of race, color, religion, sex, national origin, age, disability, or any other protected characteristic
  • Pay Hemp Temps invoices within the agreed payment terms
  • Notify Hemp Temps immediately of any worker injury, incident, or compliance concern
  • Not directly hire Hemp Temps-placed temporary workers without prior written agreement and applicable conversion fees

4. Worker Obligations

Workers registered on the Hemp Temps platform agree to:

  • Provide accurate and truthful information in their profile, including employment history and qualifications
  • Complete required background checks, training, and credentialing as requested
  • Comply with all workplace rules, safety requirements, and state cannabis compliance regulations at placement locations
  • Report to scheduled shifts on time and notify Hemp Temps in advance of any scheduling conflicts
  • Not accept direct employment from Client Companies while on a Hemp Temps temporary placement without prior written consent from Hemp Temps

5. Fees and Payment

Staffing service fees are invoiced to Client Companies based on hours worked by placed Workers, plus the applicable Hemp Temps markup. Current fee structure is described at hemptemps.com/pricing. Invoices are due within the terms stated on each invoice. Late payments may be subject to interest charges.

Hemp Temps reserves the right to suspend services to Client Companies with overdue balances. All fees are exclusive of applicable taxes, which are the responsibility of the Client Company where applicable.

6. Background Checks and Compliance

Hemp Temps conducts background checks on Workers through our screening partner CBadge in accordance with applicable federal and state law, including the Fair Credit Reporting Act (FCRA). Workers consent to background screening as part of the registration process. Results are used solely for employment eligibility assessment.

Hemp Temps does not guarantee the results of any background check and is not liable for information that was not available or disclosed at the time of screening.

7. Intellectual Property

All content on hemptemps.com — including text, graphics, logos, training materials, and software — is owned by or licensed to Hemp Temps LLC and is protected by U.S. copyright and intellectual property law. You may not reproduce, distribute, or create derivative works from any Hemp Temps content without prior written permission.

8. Disclaimer of Warranties

Hemp Temps provides its website and services on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or that Workers placed will meet all Client Company requirements.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Hemp Temps LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the fees paid by you to Hemp Temps in the three months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hemp Temps LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Denver, Colorado, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
